Terms of Service

These Terms of Service (“Terms”) govern your use of the AskBev platform operated by Hypercube Ventures Pty Ltd (ABN 69 691 185 690), trading as AskBev, (“AskBev”, “we”, “us”). By creating an account, you agree to these Terms.

1. Service Description

AskBev is an AI-powered business administration assistant for trade professionals (“tradies”). The service includes:

  • AI assistant (“Bev”) accessible via WhatsApp, SMS, and email
  • Quoting, invoicing, and PDF document generation
  • Customer relationship management
  • Appointment scheduling and compliance reminders
  • Bookkeeping assistance and accounting integration (Xero, QuickBooks)
  • Voice call handling
  • Web-based dashboard for business management

2. Eligibility and Registration

  • 2.1 AskBev is available to sole traders and small business operators in Australia and the United Kingdom.
  • 2.2 To register, you must provide a valid Australian Business Number (ABN) or UK Unique Taxpayer Reference (UTR) / VAT registration number.
  • 2.3 You must be at least 18 years of age.
  • 2.4 You are responsible for maintaining the security of your account credentials.

3. Communications Sent by AskBev

3.1 All communications are business and transactional. AskBev sends communications on your behalf and at your direction. These include quotes, invoices, appointment confirmations, payment reminders, job updates, and other operational business messages. These are transactional business communications, not marketing messages.

3.2 You represent and warrant that you have obtained appropriate consent from all individuals before using AskBev to communicate with them. This includes consent to receive business communications (quotes, invoices, reminders) via SMS, email, WhatsApp, and/or voice call, and consent to have their personal information processed by AskBev on your behalf.

3.3 You are the data controller. You are responsible for ensuring that your use of AskBev to communicate with your customers complies with all applicable laws, including — Australia: Spam Act 2003, Privacy Act 1988; United Kingdom: Privacy and Electronic Communications Regulations (PECR), UK GDPR.

3.4 AskBev is a tool. We provide the communication infrastructure. You direct what is sent, to whom, and when. You bear responsibility for the content and legality of communications sent through AskBev.

3.5 No unsubscribe mechanism. Because all communications sent by AskBev are transactional business messages initiated at your direction (not automated marketing), no unsubscribe mechanism is included. If a customer asks you to stop contacting them, you must respect that request and stop using AskBev to communicate with them.

4. AI Disclaimer

4.1 AskBev uses artificial intelligence (Anthropic Claude) to generate responses, quotes, invoices, and other outputs. AI can make errors.

4.2 Review all outputs. You are responsible for reviewing all AI-generated content before it is sent to customers or used for business purposes. This includes quotes and pricing (verify amounts, line items, tax calculations), invoices (verify accuracy before sending), and customer communications (review tone and content).

4.3 Tax calculations are indicative. AskBev calculates GST (Australia) and VAT (UK) based on standard rates. These calculations are for guidance only and do not constitute tax advice. Consult a registered tax professional for tax decisions, BAS/VAT Return lodgement, and end-of-year financials.

4.4 Not professional advice. AskBev does not provide legal, financial, accounting, or tax advice. It is a business administration tool. For professional advice, consult qualified practitioners.

5. Subscription and Payment

  • 5.1 AskBev offers subscription plans with features and limits as described on our website.
  • 5.2 Payment is processed via Stripe. By subscribing, you agree to Stripe’s terms of service.
  • 5.3 Subscriptions renew automatically. You may cancel at any time; cancellation takes effect at the end of the current billing period.
  • 5.4 We may change pricing with 30 days’ written notice. If you do not agree to the new pricing, you may cancel your subscription before the new pricing takes effect.
  • 5.5 Refunds are provided in accordance with the Australian Consumer Law (for Australian customers) or the UK Consumer Rights Act 2015 (for UK customers).

6. Your Data

  • 6.1 You own your data. All customer records, quotes, invoices, conversation history, and other business data you create through AskBev belong to you.
  • 6.2 We process your data as described in our Privacy Policy and Data Processing Agreement.
  • 6.3 Data export. You may request a full export of your data at any time. We will provide it in a standard machine-readable format (JSON/CSV) within 14 days.
  • 6.4 Data deletion. Upon account termination, we will delete your data within 30 days, except where retention is required by law (e.g., tax records retained for 7 years).

7. Acceptable Use

7.1 You must comply with our Acceptable Use Policy.

7.2 You must not use AskBev to:

  • Send unsolicited messages to individuals who have not consented
  • Engage in illegal activity
  • Harass, threaten, or abuse anyone
  • Impersonate another person or business
  • Attempt to bypass AI safety measures or manipulate the AI assistant
  • Process data that you do not have the right to process

7.3 We may suspend or terminate accounts that violate these Terms or the Acceptable Use Policy.

8. Intellectual Property

  • 8.1 AskBev platform. All rights in the AskBev platform, software, branding, and documentation belong to Hypercube Ventures Pty Ltd (trading as AskBev).
  • 8.2 Your content. You retain all rights to the business data, documents, and content you create through AskBev.
  • 8.3 Feedback. If you provide feedback or suggestions about AskBev, we may use them to improve the service without obligation to you.

9. Limitation of Liability

9.1 To the maximum extent permitted by law, AskBev’s total liability to you for any claims arising from your use of the service is limited to the amount you paid us in the 12 months preceding the claim.

9.2 We are not liable for:

  • Errors in AI-generated content that you did not review before sending
  • Loss arising from your failure to verify quotes, invoices, or tax calculations
  • Actions taken by your customers based on communications sent through AskBev
  • Third-party service outages (WhatsApp, Twilio, Xero, etc.)

9.3 Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be excluded, restricted, or modified by agreement.

9.4 UK Consumer Rights Act 2015. If you are a UK customer, nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or the Unfair Contract Terms Act 1977.

10. Termination

  • 10.1 By you. You may cancel your subscription and close your account at any time via the dashboard or by contacting support@askbev.io.
  • 10.2 By us. We may terminate your account with 30 days’ notice, or immediately if you materially breach these Terms.
  • 10.3 On termination. We will provide a 30-day data export window. After that, data will be deleted in accordance with our Privacy Policy and data retention obligations.

11. Modifications

  • 11.1 We may modify these Terms from time to time.
  • 11.2 We will notify you of material changes at least 30 days before they take effect, via email or in-app notification.
  • 11.3 Your continued use of AskBev after changes take effect constitutes acceptance of the modified Terms.

12. Governing Law

12.1 For Australian customers: these Terms are governed by the laws of New South Wales, Australia. The courts of New South Wales have exclusive jurisdiction.

12.2 For UK customers: these Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction.

Your governing law is determined by the country you select when registering your AskBev account.
